When and How"},"content":{"rendered":"<p>A divorce decree or custody order feels final \u2014 and it is meant to be stable. But Georgia law recognizes that life does not stand still: parents lose jobs, get promoted, remarry, relocate, and children&#8217;s needs change as they grow. When circumstances genuinely shift, the courts can shift with them through a modification action.<\/p>\n<p>The key phrase in Georgia modification law is a material change in circumstances. Understanding what qualifies \u2014 and what does not \u2014 determines whether your case is worth filing.<\/p>\n<h2>Modifying Child Custody: What Counts as Material Change<\/h2>\n<p>To change custody, the parent seeking modification must show a material change in circumstances affecting the child&#8217;s welfare since the last order. Georgia courts have found material change in situations such as:<\/p>\n<ul>\n<li>A parent&#8217;s relocation that makes the current schedule unworkable<\/li>\n<li>A significant change in a parent&#8217;s work schedule or living situation<\/li>\n<li>Evidence that a child&#8217;s emotional, educational or medical needs are not being met<\/li>\n<li>Substance abuse, new criminal conduct or family violence in the custodial home<\/li>\n<li>A child turning 14 and electing to change primary physical custody<\/li>\n<\/ul>\n<p>General friction between the parents, minor schedule inconveniences, or one parent&#8217;s remarriage \u2014 standing alone \u2014 usually do not qualify. Courts protect children from being bounced between homes on thin grounds, so the change must be real and child-focused.<\/p>\n<h2>Modifying Visitation: A Lower Bar<\/h2>\n<p>Changing the visitation or parenting-time schedule \u2014 without changing primary custody \u2014 is easier. Georgia allows either parent to seek a visitation modification once every two years even without proving a material change in circumstances. This is the right vehicle when the schedule that worked for a toddler no longer fits a middle-schooler with activities, or when work shifts have changed.<\/p>\n<h2>Modifying Child Support: The Two-Year Rule and Its Exceptions<\/h2>\n<p>Child support can be modified when there has been a substantial change in either parent&#8217;s income or the child&#8217;s needs. A parent generally cannot file more than one modification within two years of the last order \u2014 but that waiting period does not apply when:<\/p>\n<ul>\n<li>A parent has suffered an involuntary loss of income, such as a layoff<\/li>\n<li>The noncustodial parent has failed to exercise court-ordered visitation<\/li>\n<li>The noncustodial parent has exercised substantially more visitation than ordered<\/li>\n<\/ul>\n<p>Support does not adjust automatically. Even after a job loss, the obligation continues at the ordered amount until a court changes it \u2014 which is why filing promptly matters. Arrears that pile up while you wait are generally not retroactively forgiven.<\/p>\n<h2>The Evidence That Wins Modification Cases<\/h2>\n<p>Modification cases are decided on documentation: pay stubs and tax returns for income changes, school and medical records for the child&#8217;s needs, calendars and messages for schedule realities, and termination paperwork for involuntary job loss.
